    Description/subject: "...la commission a le regret de noter qu’il n’a pas été enregistré de progrès substantiels quant à l’application des recommandations formulées par la commission d’enquête en 1998, à savoir: 1) rendre les textes législatifs conformes à la convention (no 29) sur le travail forcé, 1930; 2) assurer que, dans la pratique, il ne soit plus imposé de travail forcé par les autorités; et 3) appliquer strictement les sanctions pénales prévues en cas d’imposition de travail forcé. La commission a rappelé que les décisions prises par la Conférence en 2000 et en 2006 concernant l’application par le Myanmar de la convention no 29 – et tous les éléments que ces décisions prévoient – restent d’actualité 1. Elle a exprimé le ferme espoir que le gouvernement s’emploiera d’urgence à faire en sorte que toutes les mesures demandées soient mises en oeuvre à tous les niveaux de l’ensemble des autorités civiles et militaires. Elle a demandé instamment que le gouvernement donne suite intégralement aux recommandations de la commission d’enquête et aux commentaires et observations de la commission d’experts sans délai.     Description/subject: "...De l'avis de la Commission, les développements récents n'ont, en outre, fait que confirmer les conclusions du Conseil d'administration à sa session de mars 2005, selon lesquelles l'attitude « d'expectative » qui prévalait parmi ses membres depuis 2001 avait perdu sa raison d'être et ne pouvait se poursuivre. De l'avis général de la commission, les gouvernements, les employeurs et les travailleurs, ainsi que d'autres organisations internationales, devraient dès maintenant activer et intensifier l'examen de leurs relations avec le Myanmar, tel qu'ils étaient appelés à le faire en vertu de la résolution de 2000 et à adopter de manière urgente les mesures appropriées, y compris en ce qui concerne l'investissement direct étranger sous toutes ses différentes formes et les relations avec les entreprises étatiques ou militaires au Myanmar. Conformément aux conclusions du Conseil d'administration de mars, les présentes conclusions devraient être communiquées à tous ceux à qui la résolution de 2000 était destinée. Les résultats de tels examens devraient dans leur intégralité faire l'objet d'un rapport au Directeur général afin que le Conseil d'administration puisse disposer d'un tableau complet de la situation. Pour ce qui est du Conseil économique et social (ECOSOC), l'on devrait lui demander de réactiver son examen de la question placée à son ordre du jour en 2001, et les membres de l'ECOSOC devraient être prêts à appuyer une telle démarche..."

The Committee recalled the continued relevance of the decisions concerning compliance by Myanmar with Convention No. 29, adopted by the Conference in 2000 and 2006, and all the elements contained therein. It expressed the firm expectation that the Government move with urgency to ensure that the actions requested are carried out at all levels and by all civil and military authorities.     Description/subject: "...The Committee called for the strengthening of the capacity available to the ILO Liaison Officer to assist the Government in addressing all of the recommendations of the Commission of Inquiry, and to ensure the effectiveness of the operation of the complaints mechanism, particularly in respect of the urgent issuance of an entry visa for an additional international professional as a priority and without delay. The Committee specifically called on the Government of Myanmar to take every opportunity, including through the continued use of all of the available forums, to increase the awareness of the people (the civil and military authorities as well as the general public) as to the law against the use of forced labour, to their rights and responsibilities under that law and of the availability of the complaints mechanism as a means of exercising those rights. An authoritative statement at the highest level would be a significant step in this regard. The Committee regretted with serious concern the continued human rights violations in Myanmar, including the detention of Daw Aung San Suu Kyi. The Committee urged her immediate release as well as that of other political prisoners and labour activists. The Committee called on the Government to investigate, without further delay, the allegations of forced labour orders and similar documents which had been submitted to the Committee of Experts and encouraged the Government to communicate to the Committee of Experts, for its next session, its findings and any consequential concrete actions taken. The Committee expected to be in a position to take note of significant developments at the next session of the Conference"

The Minister had undertaken to submit these recommendations to the highest authorities, but had indicated that he could not provide any assurances as to their acceptance...     Description/subject: "...In the view of the Committee, recent developments had further confirmed the conclusion of the Governing Body at its March 2005 session that the "wait-and-see" attitude that prevailed among most members since 2001 had lost its raison d'etre and could not continue. The Committee's general view was that Governments, Employers and Workers, as well as other international organizations, should now activate and intensify the review of their relations with Myanmar that they were called upon to make under the 2000 resolution, and to urgently take the appropriate actions, including as regards foreign direct investment in all its various forms, including relations with State- or military-owned enterprises in Myanmar. In accordance with the Conclusions of the Governing Body in March, the present Conclusions should be transmitted to all those to whom the 2000 resolution was addressed. The results of such reviews should be fully reported to the Director-General so that the Governing Body could have a complete picture in November. As regards ECOSOC, it should be requested to reactivate its consideration of the item placed on its agenda in 2001 in this regard, and Members in ECOSOC should be ready to support such a move..."

"The Committee noted the statements by the Government representative and the discussion which followed. It recalled that the Committee had discussed this serious case on many occasions in the last ten years and that its latest conclusions had been included in a special paragraph because of the continued failure of the Government to apply the Convention. Notwithstanding, the Committee was once again obliged to note the lack of real progress towards the establishment of a legislative framework for the creation of free and independent organizations. The Committee profoundly deplored the persistence of serious discrepancies between national legislation and the provisions of the Convention which had been ratified almost 50 years ago. The Committee regretted that the information provided by the Government on the existence of workers' associations had not solved the problems raised by the Committee of Experts towards implementing the Convention. Concerned about the total lack of progress towards implementing this Convention, the Committee strongly insisted once again that the Government urgently adopt the necessary measures and mechanisms for guaranteeing, both in law and in practice, the right of workers and employers to affiliate themselves with the organizations of their own choosing, without previous authorization, and the right for these organizations to affiliate themselves with federations, confederations and international organizations without the interference of state authorities. The Committee emphasized that respect for civil liberties was crucial for the exercise of freedom of association and therefore urged the Government to take the necessary measures so that workers and employers could exercise the rights guaranteed by the Convention in a climate of full security and in the absence of threats or fear. Furthermore, the Committee urged the Government to provide the Committee of Experts, next year, with all relevant draft legislation and existing legislation so that it could be studied, and to provide a detailed report on the concrete measures taken to ensure improved compliance with the Convention. The Committee expressed the firm hope it would be able to note significant progress next year. The Committee decided to include its conclusions in a special paragraph in its report. It also decided to mention this case as a case of continued failure to apply the Convention..."

Secondly, as the Myanmar authorities were told by the mission, the Office could certainly help formulate and implement such a framework if the Governments commitment to take expeditious action to this effect was made sufficiently clear in the eyes of the Conference..."
