Description: ''အဓိပ္ပာယ်ဖွင့်ဆိုချက်များ။ ၂။ ဤအက်ဥပဒေတွင် အကြောင်းအရာနှင့်ဖြစ်စေ၊ ရှေ့နောက်စကားစပ်နှင့်ဖြစ်စေ၊ ဆန့်ကျင်ချက် တစ်စုံတစ်ရာ မရှိလျှင်- (၁) ဝယ်ယူသူ ဆိုသည်မှာကုန်စည်ဝယ်ယူသူသို့မဟုတ် ကုန်စည်ဝယ်ယူရန် သဘောတူ သူကို ဆိုသည်။ (၂) လက်ရောက်ပေးအပ်ခြင်း ဆိုသည်မှာ လက်ရှိထားခြင်းကို သူတစ်ဦးက အခြားသူ တစ်ဦးသို့ မိမိ အလိုအလျောက်လွှဲပြောင်းပေးခြင်းကိုဆိုသည်။ (၃) ကုန်စည်ကိုလက်ရောက်ပေးနိုင်သော အခြေအနေသို့ ရောက်ရှိသည် ဆိုခြင်းမှာ ဝယ်ယူသူက ပဋိညာဉ်အရလက်ခံရန် တာဝန်ကျရောက်သည့် အခြေအနေသို့ ရောက်ရှိနေခြင်းဖြစ်သည်။ (၄) ကုန်စည်ပိုင်ဆိုင်ကြောင်း စာချုပ်စာတမ်း အထောက်အထား ဆိုသည့်စကားရပ် တွင် ကုန်တင် လက်မှတ်၊ ဆိပ်ကမ်းကုန်ရုံမှ ပစ္စည်းထုတ်ယူရန် ပိုင်ရှင်အား ပေးသည့် လက်မှတ်၊ ကုန်လှောင်ရုံပိုင် လက်မှတ်၊ ဆိပ်ခံတံတားပိုင်ရှင်များ လက်မှတ်၊ မီးရထား တန်ဆာ၊ ကုန်စည်လက်ရောက်ပေးအပ်ရန် လက်မှတ် သို့မဟုတ် အမိန့်စာ၊ ထို့ပြင် သာမန်အရောင်းအဝယ် လုပ်ရိုးလုပ်စဉ်၌ အသုံးပြုသော ကုန်စည် လက်ရှိဖြစ်ကြောင်း ကိုဖြစ်စေ၊ ကုန်စည်ကို စီမံအုပ်ချုပ် ကြောင်းကိုဖြစ်စေ၊ သက်သေထင်ရှားစေသည့် သို့မဟုတ် စာချုပ်စာတမ်း လက်မှတ်လက်ရှိဖြစ်သူအား အဆိုပါလက်မှတ်၌ ဖော်ပြသည့် ကုန်စည်ကို လွှဲပြောင်း ပေးရန် ဖြစ်စေ၊ လက်ခံရန်ဖြစ်စေ၊ တစ်ဆင့်ရေးမှတ်ချက်ဖြင့် သော်လည်းကောင်း၊ ပေးအပ်ခြင်းဖြင့် သော်လည်းကောင်း၊ အခွင့်အပ်နှင်းသည့် သို့မဟုတ် အခွင့် အပ်နှင်း ရာရောက်သည့် အခြားစာချုပ်စာတမ်း လက်မှတ် တစ်စုံ တစ်ရာလည်း ပါဝင်သည်။ (၅) ချို့ယွင်းချက် ဆိုသည်မှာ မတရားလုပ်ဆောင်မှု သို့မဟုတ် ပျက်ကွက်မှုကို ဆိုသည်။ (၆) အနာဂတ်ကုန်စည် ဆိုသည်မှာ အရောင်းပဋိညာဉ်ချုပ်ဆိုပြီးနောက် ရောင်းချသူက ကုန်ချောထုတ် လုပ်မည့် သို့မဟုတ် ကုန်ထုတ်လုပ်မည့် သို့မဟုတ် ရရှိမည့် ကုန်စည်ကို ဆိုသည်။ (၇) ကုန်စည် ဆိုသည်မှာ တရားစွဲဆိုတောင်းခံနိုင်သည့် ဆိုင်ရာဆိုင်ခွင့်နှင့် ငွေကြေးမှ တစ်ပါး အခြား ရွှေ့ပြောင်းနိုင်သော ပစ္စည်းအရပ်ရပ်တို့ကို ဆိုသည်။ ယင်း စကားရပ်တွင် စတော့နှင့်ရှယ်ယာများ၊ စိုက်ပျိုးထားသည့်သီးနှံများ၊ မြက်များနှင့် ရောင်းချခြင်း မပြုမီဖြစ်စေ၊ အရောင်းပဋိညာဉ်အရဖြစ်စေ၊ စီမံဆောင်ရွက်ရန် သဘောတူထားသည့် မြေ၌ စွဲကပ်ထားသော သို့မဟုတ် မြေ၏ အစိတ်အပိုင်း အဖြစ် တည်ရှိသော အရာဝတ္တုများလည်း ပါဝင်သည်။ (၈) လူမွဲခေါ် ကြွေးမြီပေးဆပ်ခြင်း မပြုနိုင်သူ ဆိုသည်မှာ သာမန်လုပ်ငန်းလုပ်ကိုင်ရာ ၌ မိမိ၏ ကြွေးမြီများပေးဆပ်ခြင်းမှ ရပ်စဲထားသူ သို့မဟုတ် လူမွဲအဖြစ် ကြွေးမြီ မပေးဆပ်နိုင်မှုကို ကျူးလွန်ခြင်းဖြင့်ဖြစ်စေ၊ မကျူးလွန်ဘဲဖြစ်စေ ပေးဆပ်ရန် အချိန်ကျရောက်သည့် ၎င်း၏ကြွေးမြီများကို ပေးဆပ်ခြင်း မပြုနိုင်သူကို ဆိုသည်။...''

Description: ''In this Act, unless there is anything repugnant in the subject or context, - (1) “buyer” means a person who buys or agrees to buy goods; (2) “delivery” means voluntary transfer of possession from one person to another ; (3) goods are said to be in a “deliverable state” when they are in such state that the buyer would under the contract be bound to take delivery of them ; (4) “document of title to goods” includes a bill of lading, dock warrant, warehouse keeper’s certificate, wharfingers’ certificate, railway receipt, warrant or order for the delivery of goods, and any other document used in the ordinary course of business as proof of the possession or control of goods or authorizing or purporting to authorize, either by endorsement or by delivery, the possessor of the document to transfer or receive goods thereby represented; (5) “fault” means wrongful act or default; (6) “future goods” means goods to be manufactured or produced or acquired by the seller after the making of the contract of sale; (7) “goods” means every kind of moveable property other than actionable claims and money; and includes stocks and shares, growing crops, grass, and things attached to or forming part of the land which are agreed to be severed before sale or under the contract of sale; (8) a person is said to be “insolvent” who has ceased to pay his debts in the ordinary course of business, or cannot pay his debts as they become due, whether he has committed an act of insolvency or not; (9) “mercantile agent” means a mercantile agent having in the customary course of business as such agent authority either to sell goods, or to consign goods for the purposes of sale, or to buy goods, or to raise money on the security of goods; (10) “price” means the money consideration for a sale of goods; (11) “property” means the general property in goods, and not merely a special property; (12) “quality of goods” includes their state or condition; (13) “seller” means a person who sells or agrees to sell goods; (14) “specific goods” means goods identified and agreed upon at the time a contract of sale is made; and (15) expressions used but not defined in this Act and defined in the Contract Act, have the meanings assigned to them in that Act, a contract for the sale of goods being a contract within the meaning of that Act...''

Description: ''Whereas it is expedient to remove doubt, and to provide an uniform rule, as to the rights of a member of a Hindu undivided family in property acquired by him by means of his learning; It is hereby enacted as follows:- Definitions. 2. In this Act, unless there is anything repugnant in the subject or context,- (a) “acquirer” means a member of a Hindu undivided family who acquires gains of learning; (b) “gains of learning” means all acquisitions of property made substantially by means of learning, whether such acquisitions be made before or after the 25th July, 1930, and whether such acquisitions be the ordinary or the extraordinary result of such learning; and (c) “learning” means education, whether elementary, technical, scientific, special or general, and training of every kind which is usually intended to enable a person to pursue any trade, industry, profession or avocation in life...''

Description: ''In this Act, unless there is anything repugnant in the subject or context,— (a) “ child ” means a person who, if a male, is under eighteen years of age, and if a female, is under fourteen years of age ; (b) “child marriage” means a marriage to which either of the contracting parties is a child ; (c) “ contracting party ” to a marriage means either of the parties whose marriage is thereby solemnized ; and (d) “ minor ” means a person of either sex who is under eighteen years of age. 3. Whoever, being a male above eighteen years of age and below twentyone contracts a child marriage shall be punishable with fine which may extend to one thousand rupees. 4. Whoever, being a male above twenty-one years of age, contracts a child marriage shall be punishable with simple imprisonment which may extend to one month, or with fine which may extend to one thousand rupees, or with both 5. Whoever performs, conducts or directs any child marriage shall be punishable with simple imprisonment which may extend to one month, or with fine which may extend to one thousand rupees, or with both, unless he proves that he had reason to believe that the marriage was not a child marriage. 6. (I) Where a minor contracts a child marriage, any person having charge of the minor, whether as parent or guardian or in any other capacity, lawful or unlawful, who does any act to promote the marriage or permits it to be solemnized, or negligently fails to prevent it from being solemnized, shall be punishable with simple imprisonment which may extend to one month, or with fine which may extend to one thousand rupees. Or with both : Provided that no woman shall be punishable with imprisonment...''

Description: ''2. In this Act. “ silver works ” means any place where silver is extracted from ore. 3 3. (/) There shall be collected at every silver works on all silver produced in such works, which is issued out of the premises of such works on and after the 17th day of March. 1930. a duly at the rate of three annas on each ounce. (2) If any duty payable under sub-section (/) is not paid within the time fixed by a notice issued in accordance with any rules made in this behalf under this Act. it shall be deemed to be an arrear. and the authority to which such duty is payable may. in lieu thereof, recover any sum not exceeding double the amount of the duty unpaid which such authority may in its discretion think it reasonable to require. (3) Any arrear of duty, or any sum recoverable in lieu thereof under sub-section (2). shall be recoverable as an arrear of income-tax in any manner prescribed in section 46 of the Burma Income-tax Act. 4. (/) No person shall issue any.silver out of the premises of any silver works except in accordance with the provisions of rules made under section 6 regulating such issue, or. until such rules are made, in accordance with the general or special orders of the President of the Union. (2) Whoever contravenes any such rule or order shall be punishable with fine which may extend to one thousand rupees or to a sum double the amount of the duty on any silver issued in contravention of such rule or order, whichever is greater. 5. The President of the Union may, by notification in the Gazette, declare that any of the provisions of the Sea Customs Act relating to the levy of and exemption from customs duties, drawback of duty, warehousing, offences and penalties, confiscation, and the procedure relating to offences and appeals, shall, with such modifications and alterations as he may consider necessary or desirable to adapt them to the circumstances, be applicable in regard to like matters in respect of the duty on silver imposed by section 3....''
